Terms of Service

By creating an account or using Daily Spark (operated by Victor Davidson at spark-me-up.com), you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

We may update these terms from time to time. If we make material changes, we will notify you by email at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance of the revised terms.

You must be at least 16 years old to use Daily Spark. By creating an account you confirm that you meet this requirement. If you are using the service on behalf of an organisation, you confirm you have authority to bind that organisation to these terms.

• You are responsible for keeping your password secure and for all activity that occurs under your account.
• You must provide accurate information when signing up and keep it up to date.
• You may not share your account with others or create multiple accounts to circumvent limits.
• Notify us immediately at hello@spark-me-up.com if you suspect unauthorised access to your account.

Daily Spark is a paid subscription service. After a 30-day free trial, continued access requires an active paid subscription.

• Subscriptions are billed monthly and renew automatically until cancelled.
• You can cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period — you retain access until then.
• We do not offer refunds for partial billing periods, except where required by applicable law.
• Prices may change with 30 days notice. We will email you before any price increase affects your subscription.
• All payments are processed by Stripe. We never store your card details.

Daily Spark delivers one AI-generated motivational message per day — by email, or by text message if you opt in — personalised based on your preferences and feedback. We aim to send your message at your chosen time each day, but delivery times are not guaranteed and may vary due to factors outside our control, including email and mobile carrier delays.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. If we discontinue the service entirely, we will provide at least 30 days notice and a prorated refund for any unused subscription period.

You may choose to receive your Daily Spark by text message instead of email. Text delivery is optional — email is always available — and consent to receive texts is not a condition of purchasing any subscription. By providing your mobile number and opting in, you consent to receive recurring automated text messages from Daily Spark at the number you provide.

• Program name: Daily Spark SMS.
• Program description: recurring daily motivational messages, plus occasional account- or service-related messages.
• Message frequency: approximately one message per day; frequency may vary.
• Message and data rates may apply. Charges are set by your mobile carrier and are your responsibility — Daily Spark is not responsible for carrier charges.
• To stop receiving text messages, reply STOP to any message at any time. You will receive a one-time confirmation and no further texts unless you opt back in.
• For help, reply HELP to any message, or email hello@spark-me-up.com.
• Carriers are not liable for any delayed or undelivered messages.
• Supported carriers may change, and we cannot guarantee that every carrier will deliver every message.

SMS non-sharing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data, consent, and related personal information will not be shared with any third parties unless required by law or necessary to deliver SMS services.

Messages sent by Daily Spark are generated by Anthropic's Claude AI model. By using the service you acknowledge that:

• Content is AI-generated and for motivational and informational purposes only. It is not professional medical, psychological, therapeutic, or legal advice.
• If you are experiencing a mental health crisis or emergency, please contact a qualified professional or emergency service.
• AI-generated content may occasionally be imperfect, inaccurate, or not suited to your situation.
• You should use your own judgement when acting on anything in a Daily Spark message.

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorised access to any part of the service or its infrastructure.
• Resell, sublicense, or commercially exploit the service or the content we deliver to you.
• Use automated tools to scrape, crawl, or extract data from the service.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

The Daily Spark brand, website, and software are owned by us and protected by applicable intellectual property laws. The AI-generated message content delivered to your inbox is provided for your personal use only and may not be republished or redistributed without our permission.

Feedback you send us (by replying to emails or otherwise) may be used to improve the service and personalise your future messages. You retain ownership of that content and grant us a limited licence to use it solely for those purposes.

To the maximum extent permitted by applicable law, Daily Spark and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service — including but not limited to loss of data, lost profits, or emotional distress.

Our total liability to you for any claim arising out of or relating to these terms or the service is limited to the amount you paid us in the 12 months preceding the claim.

You may delete your account at any time from your dashboard. We may suspend or terminate your account if you violate these terms or if we have reason to believe your use of the service is harmful. Where possible, we will give you notice and an opportunity to remedy the issue before terminating.

On termination, your right to use the service ends immediately. Sections of these terms that by their nature should survive termination will do so, including limitation of liability and intellectual property provisions.

These terms are governed by the laws of the jurisdiction in which the service operator is based, without regard to conflict of law principles. Any disputes will be resolved in the courts of that jurisdiction, except where mandatory consumer protection laws in your country provide otherwise.
